Who may petition for an adoption in Minnesota?
Any person who has resided in the state for at least one year may petition to adopt a child or an adult in Minnesota. A Minnesota court may waive any residence requirement if the petitioner is related to the child or is a member of a child’s extended family.
Typically, a petition for adoption may not be filed unless the child or children have been placed by a commissioner of human services or a licensed child-placing agency.
However, if the person to be adopted meets the following requirements, then no approval from the commissioner or child-placing agency will be required:
- The person to be adopted is over 14 years of age;
- The child is sought to be adopted by an individual who is related to the child as a spouse, a parent, a natural or adopted child or stepchild, a stepparent, or other close relationship;
- The child or children has been placed in Minnesota or another state, under another state’s laws
- The court waives the requirement because it is in the best interests of the child the or petitioners to do so.
